General Terms and Conditions for Tour Services

This agreement (“Agreement”) is entered into between San Sebastian by Jone (“Company”) and the individual or entity (“Customer”) engaging the services provided by the Company through its website or other means.

1. Booking and Payment

1.1. The Customer agrees to book tour services through the Company’s website or by contacting the Company directly.
1.2. The Customer agrees to pay the total cost of the tour as specified on the Company’s website or as communicated by the Company.
1.3. Payment must be made in full at the time of booking unless otherwise agreed upon in writing by the Company.

2. Cancellations and Refunds

2.1. The Customer may cancel their booking subject to the Company’s cancellation policy, which may include applicable fees or penalties.
2.2. Refunds, if applicable, will be processed in accordance with the Company’s refund policy.

3. Tour Services

3.1. The Company agrees to provide the tour services as described on its website or as agreed upon in writing with the Customer.
3.2. The Company reserves the right to make changes to the itinerary, accommodations, or other aspects of the tour as necessary, provided that such changes do not materially affect the overall quality of the tour.

4. Liability

4.1. The Company shall not be liable for any loss, damage, injury, or delay incurred by the Customer during the tour, except to the extent caused by the Company’s negligence or wilful misconduct.
4.2. The Customer acknowledges and agrees that participation in the tour involves certain inherent risks, and the Company shall not be liable for any injuries or damages resulting from such risks.

5. Governing Law and Jurisdiction

5.1. This Agreement shall be governed by and construed in accordance with the laws of the Spanish legislation.
5.2. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of San Sebastian.

6. Miscellaneous

6.1. This Agreement constitutes the entire agreement between the parties with respect to the subject matter here of and supersedes all prior agreements and understandings, whether written or oral.
6.2. This Agreement may not be amended or modified except in writing signed by both parties.

7. Right to Images

7.1. The Customer acknowledges and agrees that the Company may take photographs, videos, or other images during the tour for promotional or marketing purposes.
7.2. By participating in the tour, the Customer grants the Company the irrevocable and unrestricted right to use and publish such images, without compensation or further consent, in any media or format, for the purpose of promoting the Company’s services.
7.3. The Customer releases the Company from any claims or liability arising from the use of such images, including but not limited to claims for defamation, invasion of privacy, or infringement of intellectual property rights.
7.4. If the Customer does not wish to be photographed or recorded during the tour, they must notify the Company in writing prior to the commencement of the tour.
This clause outlines the Company’s right to use images taken during the tour for promotional purposes and clarifies the Customer’s consent and release of liability regarding the use of such images.

8. Acceptance

By booking tour services with the Company, the Customer acknowledges that they have read, understood, and agreed to be bound by these General Terms and Conditions.



Cancellations and Refunds Policy

Cancellation of the tour on part of the client:

Cancellations done 7 days before the tour will be refunded 100% of the activities price, minus any expenses that may come from the process.

Cancellations done between 6 and 4 days before the tour will be refunded 50% of the activities price, minus any expenses that may come from the process.

Process expenses:

  • European cards: 1’65%
  • Non-European cards: 3’15%


Cancellations done in less than 4 days before the tour will have no refunds.

Cancellation of the tour on the part of San Sebastian by Jone:

In the event of a tour cancelled by San Sebastian by Jone, we will try to find another available date that suits the client. If this is not possible, a full refund will be applied.

Payment Policies:

If we do not receive the payment in the first 72 hours after sending the “payment request” or “bill”, the pre-booking will be cancelled.

Not showing up to the activity eliminates the right to ask for a refund of the money by the client – either way, we wait 5 courtesy minutes before starting any activity.
